What a problem it’s turning out to be if you are a Toyota car owner.
With over 180,000 UK cars across its full range awaiting recall for modifying a sticky accelerator pedal there is now a further dilemma they face.
The issue raised is the car insurance policy, are Toyota drivers who drive their cars on the road, when having been informed there is a significant fault with their car, legally covered by insurance?
Some lawyers have stated that to drive a car knowingly in such a condition is in breach of the insurance cover whether there is an accident or not.
It is also quite possible the police could prosecute a driver for knowingly driving a car with a known dangerous fault.
To add to the controversy the Association of British Insurers have stated that ALL motor insurance covering Toyota will remain in force.
However what does remain unanswered at this moment is – if there was a serious accident involving a known faulty Toyota what would be the legal outcome, lawyers are still unsure whether the driver would face criminal or civil prosecution.
For the poor Toyota driver the best advice being given by a lawyer would be to keep your car off the road until you get the garage to collect your car for modifying, not the best news but probably the safest.
